In the following, we want you to know for what purpose we collect, process and use your personal data in connection with our website and the service offers we make via Internet (summarised below as "processing"). Personal data means any information relating to an identified or identifiable natural person.

YOUR CONSENT

The processing of your personal data is governed by the applicable legal provisions, in particular the Federal Act on Data Protection and its implementing provisions. If we use data for a purpose that requires your consent under these provisions, we will ask you for your express consent in each case. Once you have given your consent, you can withdraw it at any time with effect for the future and/or object to future use of your data. The mere use of our website or the acknowledgement of this data protection notice does not replace your express consent. Section 11 of this data protection statement informs you about your further rights.


PROCESSING OF THE DATA

When you access our website, technical information such as the type of web browser, the operating system used, the domain name of your Internet service provider and similar information is collected, which we use for the technical processing of the use of the website and analyse statistically. This information does not allow any conclusions to be drawn about your identity.

If you wish to use personalised services on our website, such as the booking or job application function, you must register personally. We process the data that you enter, such as your name, home address, contact and communication data (such as telephone number and e-mail address), payment details, etc., as well as other data that you may generate or enter during registration, when using our website or when communicating with us, or that you transmit in any other way, e.g. by e-mail or telephone, exclusively in connection with the purpose you have selected.

We store your personal data on a server in Switzerland that is protected in accordance with the provisions of data protection law.

In summary, it can be stated that your personal data will always be processed in accordance with the Federal data protection law.


PROTECTION OF YOUR DATA

We have taken technical and organisational measures to ensure that the data protection requirements are adhered to, both by us as well as by external service providers who work for us.

The unencrypted transfer of data over public networks, for example by e-mail, may be read by, changed or destroyed by unauthorised third parties. Any transmission of data when using our website is therefore at your own risk.


SUBSCRIBE TO OUR NEWSLETTER

You have the option of subscribing to our newsletter on our website. Registration is required for this. The following data must be provided as part of the registration process:

  • First name and surname
  • E-mail address

The above data is necessary for the provision of the newsletter. In addition, you can voluntarily provide further data such as your individual interests. We process this data exclusively to personalise the information and offers sent to you and to better tailor them to your interests.

By registering, you give us your consent to process the data provided for the regular dispatch of the newsletter to the address you have provided and for the statistical evaluation of user behaviour and the optimisation of the newsletter. We would like to point out that we use third parties for the technical processing of the e-mail dispatch, which may be based in countries that do not have a level of data protection equivalent to that in Switzerland. We currently work with mailchimp.com, which is based in the USA. For further details regarding data protection in the USA, please refer to section 10 and the data proetection statement of mailchimp.com.

At the end of each newsletter you will find a link to unsubscribe from the newsletter at any time. When unsubscribing, you can voluntarily inform us of the reason for unsubscribing. After cancellation, your personal data will be deleted. The data will only be processed further in anonymised form to optimise our newsletter.


APPLYING FOR A JOB

You can apply for a job on our website. To do so, it is necessary that you provide us with at least the following data:

  • Surname, first name, title
  • Residential address
  • e-mail
  • telephone number
  • CV as attachment (e.g. as pdf, ppt)

The data collected is stored directly on one of our own servers, which are operated in Switzerland, in the website database. From there, the data is forwarded to our Human Resources department as e-mail with attachments. The names of the attachments are automatically anonymised. In order to be able to send an application, your consent to the use of Google reCAPTCHA is required. This tool ensures that applications submitted by people can be distinguished from those submitted by a robot. If you have rejected the use of reCAPTCHA when setting the cookies, a banner will appear after clicking on "Apply now", on which you can agree to the use of reCAPTCHA. If you do not wish to do this, you cannot send your application via our applicant tool. However, you can contact the Human Resources department directly at any time and apply by e-mail. The data on the website server is usually deleted on a monthly basis. The Human Resources department usually deletes the data received from applicants from its system once a quarter if no employment is made.


BOOKING OF SERVICES AND USE OF OUR SHOP

You can book various services on our website, such as reserving a hotel room or attending a specialist lecture. We work together with various service providers for these purposes (e.g. Travelclick). The data you enter will be used exclusively for processing the corresponding booking, providing the requested services and for billing and collecting our services. If services are provided by third parties via their own website, e.g. Travelclick, their data protection provisions apply to the services provided by these third parties. Oberwaid AG bears no responsibility for the data processing of these third parties.

Depending on the payment method selected, your data will be forwarded to third parties for the processing of the payment. In this regard, we refer you to the corresponding data protection declarations of the third-party providers. In the context of debt collection, your data may be passed on to debt collection companies, authorities such as the debt enforcement office and courts.

In connection with the purchase of vouchers and tickets, we work together with e‑guma.ch, a Swiss company that stores and processes your data in Switzerland or the EU. Vouchers and tickets are purchased on the e-guma platform, to which you are automatically redirected when you use our shop. For information on e-guma's data protection, please refer to e-guma's privacy statement. We contractually ensure that e-guma processes your data in accordance with the requirements of the law. 

Hotel bookings are made via travelclick.com, which is based in the USA, a country that is not considered secure from a data protection perspective. With regard to data protection, please refer to section 10 and the travelclick.com website. We contractually ensure that travelclick.com processes your data in accordance with the law. 


COOKIES AND WEBANALYSIS

Cookies are text files stored on your computer's hard drive and accessed by our server each time you visit our website. We use cookies to make it more user-friendly. You can prevent or restrict the storage of cookies on your hard disk by setting your browser so that it does not accept cookies or asks you whether you agree before setting cookies. Once cookies have been set, you can delete them at any time. Please refer to your browser’s operating instructions to find out how this works. If you do not accept cookies, this may lead to restrictions in the use of our service.

We use matomo software to analyse user behaviour on our website. This is operated by us on our servers and fulfils the requirements of the Federal Act on Data Protection Act. For details, please refer to the cookie banner.



THIRD PARTY OFFERS

Our website may contain references to third-party offers in the form of links, advertising banners or similar. If you follow these links (usually by clicking on the link or advertising banner), you will be taken to third-party offers. We would like to point out that we are not the data controller for such offers in accordance with data protection law. The data protection provisions of the third party apply exclusively to third-party offers, as the third party is the controller in accordance with data protection law.


DISCLOSURE TO THIRD PARTIES

We may disclose your personal data to third parties in order to make use of technical or organisational services or to perform our services. The third parties involved are contractually obliged to process the personal data exclusively on our behalf and in accordance with our instructions. We also oblige the third parties involved to comply with technical and organisational measures that ensure the protection of personal data. If the service providers are located in countries in which the applicable laws do not provide for personal data protection comparable to Swiss law, we contractually ensure that the service providers concerned comply with the Swiss level of data protection. Where necessary, you will be asked for your consent to the transfer of data.


YOUR RIGHTS

You have the right at any time to request information about the personal data we have stored about you. You can also request the correction, blocking or partial or complete erasure of your personal data at any time, provided that your request does not conflict with any statutory retention periods. You can also object at any time to the use of your e-mail address or the processing of other personal data that you have provided to us. STORAGE AND DELETION OF PERSONAL DATA

The personal data stored about you will be irretrievably deleted as soon as it is no longer required for the purposes for which it was collected or if you request this, provided this does not conflict with any legal obligations of safekeeping or retention. Anonymised or aggregated data that cannot be assigned to a specific person may also be processed for internal purposes such as the further development of our services.

We reserve the right to amend this Data Protection Statement in whole or in part at any time without prior notice. In any case, the current privacy policy published on our website applies.
